Child Support Information

My husband has to pay child support. There are several states difference in our living situation. The x-wife has the child for school. We get her for vacations. We know that she has to be sent to us with clothing. We have had problems with the ex complying with this. She sent us with clothing last time, but packed clothes that were way too small for the child to wear. If we have to buy clothing for the child while she is with us, can we give a copy of the receipt to the ex, send the clothing back up with the child and then deduct the money we had to spend from the next months child support payment?

There is no law requiring a parent to send clothes with a child for visitation. Absent cooperation from the parent, your only choice is to acquire a wardrobe for the child or use what is sent. You should be aware that under Utah law, if you have the child for more than 25 consecutive days that your husband can reduce child support by 50% - and could use that money for her clothes.

You cannot deduct the cost of clothes from child support.
