Legal Question in Family Law in Utah

Deductions to alimony?

My ex-wife still owes me $500 from a tax bill that I paid. The bill came after our divorce but was for when we were married and filed jointly. The total bill was $1000 and I sent her a bill for half and now she won't pay. Can I deduct the $500 from the alimony I send her every month?

Re: Deductions to alimony?

If your decree provides that she would pay one half of the amount, and she does not pay, then you could deduct one half. You may want your lawyer to review the decree to see who has responsibility for the debt. Some decrees will state who is responsible for unnamed debts. If it is not covered you take a chance, however, her remedy would be to go back to court for an order to pay her the amount you deducted.
