Fathers family not allowed rights!

I'm from Utah. Right now my son is in the Prison and is due to be released Oct 2003. Recently The mother of his daughternot only abbandonded my granddaughter, but signed temp. custody over to her mother because of a threat of loosing full custody. We are not allowed to keep my grand daughter over night at this time. Can the other grandmother do this? Can my son get custody or at least some rights, or can I get visitation because the other grandparent opened the door. There are no grandparents rights in Utah.

There are formal grandparent rights in Utah and you can file for your grandparent rights in the Utah State district court where the granddaughter lives (assuming the granddaughter lives in Utah). If your son has not waived his parental rights, and absent any problems which would preclude parental custody, he should be able to obtain custody upon his release. At a minimum, he is entitled to visitation rights. He may also need to file in court to protect his rights.
