Hearing

Does a child have to be born in order to file a Motion for Temporary Relief of Custody. Also can I get a court order to be notified when child is born since me and my pregnant ex-girlfriend have no communication at all

When the child is born obtain and sign from the Department of Vital Statistics a Voluntary Declaration of Paternity, and also contact the Office of Recovery Services and declare your paternity to them. If you want visitation rights you will need the assistance of an attorney.

You can file a Parentage Petition before the child is born and have it served on the mother. Once the child is born, you can file a motion with the court requesting temporary orders during the pendency of the case.
