Legal Question in Immigration Law in Utah

WORK VISA thru a sponsorship

In terms of sponsoring a visitor.

Can I as a permanent resident by opening a business sponsor a person who's on a visitor visa to obtain a work visa.

We are thinking of actually opening a limited liability company and can't decide whether he, the visitor, should be a parnter in the company or just an employee. Does it make any difference whether a partner or an employee for the sake of obtaining a work visa?

Finally, if the above-mentioned works for obtaining a work visa, how do we go about it.

Any feedback would be greatly appreciated.

Thanks

Yes...you can sponsor the visitor...but he should not be a partner..he should just be an employee. You can do labor certification for him... at the last stage of the process..need to show that you have been paying him preveiling wages...and company makes enough money to pay his salary. With a new business sometimes that is hard to show!!!!!Please take a look at my site at www.lawyers.com/amyghosh
