Legal Question in Employment Law in Utah

employment file

I was involved with an incident at my work, (a coworker put a knife to my throat) I requested the letter I signed with the statement of my coworker and my self and others. The coworker was fired but allowed to still work in the counseling field. I requested the letter for myself and I was given the response that it does not have anything to do with my file so they wont give it to me! I am thinking about filling criminal charges against the coworker but I am unsure if my work will support me now? I am worried now that my job might treat me unfairly for requesting the letter?

Re: employment file

If your employer doesn't support you or treats you unfairly it won't likely be from requesting the letter. You are entitled to certain documents from your file but not from other files. For employment purposes your co-worker's statement is your co-worker's, not yours, and it's not inappropriate to withhold it from you. If you file charges the attorneys can have access through court procedures.
