Legal Question in Personal Injury in Utah

Food Poisoning

I aquired a campylobacter intestional infection from eating at a local restaurant which required 5 days of hospitalization. The local health department had several cases reported during a 2 week period but none of the cases including mine could be linked. Campylobacter is a bacteria that is easily killed and is normally not found in ''large outbreaks'' but just in isolated cases. My infection was very serious and caused toxic mega colon and sepsis as the infection traveled to my bloodstream due to moderate gastro intestinal bleeding. I was told I could die. This began June 15 and as of yet I am still not able to return to work. Tests done in the hospital confirmed that my immune system did not respond. I have seen a specialist who is determining what auto immune disease process has been triggered as a result of this serious illness. At this point I suffer from extreme fatigue and weakness. I don't know if this particular restaurant can be held liable for this because the health department could not link it to the bacteria and it is basically my word against theirs. I called the restaurant when I was in the hospital and told them I had gotten food poisoning from them but their manager was very rude and short with me. Any advice?

Re: Food Poisoning

In order to prevail in a case against the restaurant you would have to show that it is more likely than not that you got the infection from the restaurant.

The particulars of your case will determing the likelihood, such as the experience and testimony of those who were with you at the restaurant. I just finished a similar case, so if you want to call for a free consultation, I would be happy to visit with you.
