Lease termination timeframe, etc

I have just attempted (on 9/22/07) to terminate my lease while it is still a month-to-month, but the landlord indicates that I am too late and it will convert to a yearly lease which I will be breaking if I leave. Here is the clause from the lease:

''This agreement shall commence on July 1, 2007. Through September 30th, 2007, the

lease shall be on a month-to-month basis, with 30 days notice required by either

party to terminate the lease. After September 30th, 2007 it shall convert to a

yearly lease with a termination date of June 31, 2008.''

Is the landlord right in saying that I had to give notice by Sept 1 in order to prevent this lease from converting to a yearly fixed?

Based on what you submitted, you are required to give 30 days notice in advance of Sept 30.
