Legal Question in Real Estate Law in Utah

I recently built/bought a home and the Homebuilder told me there was no HOA and my contract shows this. Nine months later I received a bill with late fees from the HOA. I haven't signed anything. Do I have to join the HOA or cancel my entire contract? Since I am the first owner--is there a way out of the HOA?

If your home was built in a subdivision that had a HOA you should have received notice of the HOA at closing. You cannot get out of a HOA, your property was a part of the HOA at the time you purchased. You will have to pay the fees.
