Legal Question in Banking Law in Virginia

Uncashed checks

I wrote check to a title company for a real estate clsoing in January 2001. 15 months later, the title company calls and says that they are being audited and cannot find a copy of my check. The problem is that I do not get cancelled checks bask from the bank nor do I have a banking realtionship with that bank any longer. Furthermore, i have found no evidence that the check was actually cashed. What responsibility do I have to respond to the title company? DO I need to spend money tracking doen copies of checks and back statemnents? What if the check was never cashed? Can they make me pay it now?

Re: Uncashed checks

You don't need to spend money tracking down checks, but if it was never cashed they can require you to replace the check.
