What type of civil liability is involved when an employer instructs his employee to seek employment with a competitor in order to get private information by hacking into their emails? Then forwarding the information found back to the previous employer. Who in returns forward the information to their location overseas

If the employee were to succeed in the hacking, then his (former)employer as well as the hacker could be civilly liable for tortious interference with the business relations of the competitor, invasion of privacy, and probably other business-related torts.
