Legal Question in Business Law in Virginia

sales commission plan changing just before deal closes

I am working in software sales for a

fast growing company, and I am

about to close a major deal, one of

the largest in the company's history.

I have been working the deal for over

six months, and the final amount of

the deal has been known for over

three months. Now, just as the deal

is about to close, my company is

trying to institute a new comp plan

that will effectively reduce my

commission by over $150K on this

deal alone. I understand that they

claim the right to change the plan

anytime, but the timing of this is

obviously designed to specifically

reduce my commission on a deal that

they have known would close for

months. Do I have any recourse?

Re: sales commission plan changing just before deal closes

Since the deal has apparently not yet been completed and consequently your commission not yet earned, probably not.
