What is a Civil Penalty ?

A family member was caught shoplifiting in a store and the loss prevention officer told the person that he had them on camera along with several other times that they had taken something. They were then asked to make a list of items taken and sign and then taken up front to pay for items. She thought it was all said and done but received a letter today from a lawyer in Florida saying that she needed to make payment of $369.99 for a civil penalty(within 20 days) to avoid furthur action. What exactly are they talking about? (she was not prosecuted, it was all handled ''in store'')

It sounds like the company is attempting to obtain a civil judgment against your family member. Depending on exactly what they signed and what they paid, they may still owe additional money to the store, which they are now attempting to collect.

However, Florida law differs from Virginia law, so it is hard to be precise. Moreover, I'd need to examine all the paperwork involved to get a full feel for the matter. Your family member should seek legal counsel in Florida immediately just to protect themselves.
