Legal Question in Civil Rights Law in Virginia

Layoff

I currently work for a privately owned hospital. Our department is experiencing layoffs/downsizing. Out of the three technicians I have the most seniority and the best work performance evaluation. I recently accepted a job position with the federal government, but I dont start until July 6, 2009. My managers boss stated that I should be the tech to go because I have another job. This month is April and I my bills dont stop. Is that right for them to do this when I have the most seniority and the best work performance???

I don't know about the "rightness" of it, but apparently there's nothing to prevent your employer from doing it unless you're currently protected by a contract which says otherwise.
