Legal Question in Consumer Law in Virginia

flooring company

this flooring company agreed to have

my hardwood floors done by october

4th (the day of my baby shower). In

the contract it stated that they could

take longer if needed. We agreed on

a price and they told me they weren't

going to charge me for the trim. I

didn't ask for it for free, i would have

paid for it if I had known that after 4

months i would still be waiting for it.

I've called the place 3 times and they

keep putting it off. I just want them

to finish my floors!

Re: flooring company

did you already pay them? If you lack confidence in their ability to finish (including their organization and willingness), you can go out and hire someone else to do the work. And then you can collect from the first company any extra that it cost you. They are responsible for any replacement by some other company.

And that threat might get them to get the work done.

But other than just making demands, if you sue the court will not force them to do the work. The court will only award an amount of your financial loss. And that is measured in terms of finding someone else to do the work instead. If someone else costs more, including because of the need to work around their half-done work or re-do the work, they are responsible for your extra costs.
