Legal Question in Credit and Debt Law in Virginia

Can a bank where you have a credit card take you to court if your are making monthly payments, but not the minimum that they are asking for? My son is making payments every month, around $50 to $75 a month, but the bank is still harassing him daily with phone calls and sending nasty letters. I always thought that if you were making an attempt monthly to pay it off they could not take you to court. Of course he will never get it paid off because the interest tacked on makes the amount go up every month even with the payments. I guess the next step is bankruptcy. What a shame.

Yes, I agree, i.e., "what a shame". But, unfortunately, what you've described

the bank as doing probably falls just short of the line crossing over into illegality

(in my opinion).
