Legal Question in Credit and Debt Law in Virginia

Credit Card Lawsuit

Hello, I am being sued by Bank of America for a Mastercard debt. The amount is $1,196.46. I will not be able to appear on October 16th in court and I do not have the money to pay this debt. Should I write a letter to the General District Court in Norfolk, VA explaining why I will not be able to show up? How can I protect a property I have in NYC from this and other possible lawsuits? Thank you.

Re: Credit Card Lawsuit

If you fail to appear for the hearing in Norfolk, the court will likely enter a default judgment against you(whether or not you submit a letter).

Your judgment creditor can only take action to enforce the judgment in states where the judgment is recognized

as valid for that purpose and against assets which have been properly identified as attachable or seizable for that purpose.
