How much time can a person get for first offense assault on a police officer?

Section 18.2-57(C)of the Virginia Criminal Code classifies a knowing and deliberate assault on a law enforcement officer as a Class 6 felony, punishable by incarceration of 1-5 years in the state penitentiary, or 12 months in the local jail and a fine of up to $2500, either of which includes mandatory incarceration of at least six months.
