conceal weapon

i went to court for a loaded gun that i told the officer was in my truck before he checked car. the gun belonged to a security company i work for.when i was asked by the officers could they search my car i wasn't even in the car.anyway when i went to court the charges was dismissed but they kept the gun.can they do that?also i believe the way things went in the court i shouidn't been charged with having a conceal weapon being it was in the truck?the va law section is18-2-308

The owner of the firearm should send a written request to the prosecutor's office requesting the return of the weapon to its rightful owner.

(Your experience again illustrates what I've said in this forum many times before, i.e., one should never consent to a police search of one's home or vehicle without a proper warrant being presnted by the officer.)
