Legal Question in Criminal Law in Virginia

Habitual Offender?

I was on probation for an alcohol and destruction of private property offense. I was arrested at a party at a friends house for possession of alcohol. I blew a .08 into a breathalizer. The next weekend I was with a friend at a football game and was arrested drunk in public & on school grounds. Will these charges classify me as a habitual offender and if so does that upgrade these misdemeanor to a felony? What punishment could I be looking at?

Re: Habitual Offender?

Instead of habitual offender status, Virginia now focuses on the number of offenses of driving under the influence within a 5 and 10 year time frame. Penalties are imposed pursuant to statutory parameters. Read the primer on http://www.vatrafficlaw.com for guidance.
