Legal Question in Criminal Law in Virginia

A Replevin Order

A relative has been told that a company has a Replevin Order on him for what he suspects is an old car note he failed to keep up. The car was repossessed two years ago but just this week, an ''investigator'' from a law firm called to suggest that a company was about to ''come down hard on him'' with a Replevin Order so he called me to ask if I knew what it was. I researched until I found your website.

Can you give me an idea? I've never heard of it before.

Re: A Replevin Order

It all probability it's likely an order for your friend to pay a deficiency arising from the sale of his repossessed car and what he owed on the note. In other words, whatever the loan company (or note holder)received from the sale of the vehicle was not sufficient to cover the balance still owed on the note, so now they or their surrogates expect your friend to pay the difference.

Your friend should demand to have copies of all paperwork connected with this matter and then arrange to consult with an attorney knowledgeable in these matters to ensure that this so-called replevin order is in fact legitimate.
