Legal Question in Criminal Law in Virginia

Underage Possession By Consumption

I am 19 years old and I was

convicted of underage possession of

alcohol by consumption along with

like 20 others. I blew a .07 on a hand

held breathalyzer. This is my first

offense for anything other than

speeding. Should I get a lawyer. I

don't mind doing alcohol classes or

community service but I don't know

what I would do without my license.

Is there a good chance that I will lose

it? The officer said no but I am not

sure and it worries me. How much

should I expect to pay for a lawyer?

Thanks, Cody

Re: Underage Possession By Consumption

Yes, upon conviction your license will be suspended for at least six months, but you can apply to the court for a restricted privilege. (See Va. Code Sec. 4.1-305(C).

If you have no previous convictions, you should attempt to get a deferrred disposition which will allow you to emerge from this situation with no record of a conviction if you successfully complete the conditions of your probation. (See Va. Code Sec. 4.1-305(F)

A lawyer would probably cost you around $500 or so for this case.
