Changing separation agreement

The question I have is my husband and I separated July 2001 in the separation agreement it states that he remain in the house until it is sold, he has taken the house OFF the market therefore it can't be sold. We went through the same should I obtain my own lawyer and force him to put it back on the market? The other part of my question is that in 1999 we bought a house using $20,000 of money that my mother left me, then he decides he doesnt love me and wants a divorce after we used the money for a second mortgage stating that he didn't love me when we bought the house. do I have a right to get that money back ???
