Child Custody

My fiancee has a 3 yr old daughter and him and his ex wife have joint custody. He gets her every other weekend. She is refusing to sign the admittance form to finalize the divorce. I was wondering if we filed for custody of his daughter what are the likely chances we'd win? She lives with her mom, dad and her new bf is there all the time. My fiancee and I have our own town house and have a seperate room for her where his ex does'nt. She's only 3 so not in school yet. They live in an area where it's secluded and the house is dirty. His ex takes the daughter to her aunts apt where there are shootings all the time. What do you think would be our chances of custody?

Apparently, a court of proper jurisdiction, having reviewed the matter of custody, decided that the parents should share custody of the child under the terms which you've described. And, unless there's been some material change in the circumstances of the mother in the intervening period which is likely to adversely impact the best interests of the child, it's unlikely that the court would authorize any change in the current custody arrangements.
