Child custody rights for tourists

What rights does a tourist have when he brings his 3 yr. old son from the Philippines and his spouse who is here under a DOD permanent status arranges for this child to be in the custody of her relatives. Generally, the wife has now reneged on her promise to the husband that she will petition for both husband and child. An Elian Gonzalez scenario.

in the area where you are staying and(presumably where the child is)who is familar with family as well as immigration law issues, and who will be able to advise you on your situation.
