Legal Question in Family Law in Virginia

Child support review - every 2 yrs

In our custody papers it says that the child support will be reviewed every two years. DCSE collects the support for me, do I notify them of the needed review, or because we settled through a mediator do I contact him ? How long does a review usually take ? The non-custodial parent resides out of state, does that effect the review ?

Re: Child support review - every 2 yrs

As the former District Administrator of the NoVa DCSE office(some 20 years ago), I can authoritatively tell you that the person who calls her district office around the time that the review is due is more likely to have it happen than the one who doesn't bother and just assumes that it will be taken care of.

Each case is different with respect to a review and it likely is no easier

to predict how much time the review process is likely to now take with a given case than it was 20 years ago.

And, yes, if the obligor resides out of state, the review will take even longer since DCSE must make a referral to its sister agency in that particular state to carry out the review and to adjust the non-custodial parent's obligation accordingly, if such is required.
