if couples are getting a divorce, is it the law that one party has to pay child support even though the other party is not asking for it?

No, it is not the law. Under the law, each parent has a duty to support

his or her child but which, depending upon the particular circumstances of the case, may not necessarily translate into the actual payment of monetary support for the subject child(ren) for a variety of reasons.
