Legal Question in Family Law in Virginia

Divorce

I have had a legal separation and property settlement agreement since January 8, 2002. My husband was supposed to complete the filing of the divorce and it's ridiculous that this is still ongoing. Is the Virginia Decree of Divorce the only form I need? Can I file it with the court myself? I rarely talk to him and I don't even know where he lives. (nor do I care to know).

Re: Divorce

Yes, you can initiate the divorce, file the property settlement agreeement and the other required papers along with the final decree.

You will, however, need to have a correct address where your husband can be properly served with the papers in order to avoid having to seek the court's permission to effect the required notice by publication.
