Legal Question in Family Law in Virginia

If a father petitions the court in which you and child used to live to have a childs last name his, that he hasnt had anything to do with him in 7 years, which jurisdiction should this case be filled in? The county we did file in or the county we live in now?

According to Section 8.01-217 of the Code of Virginia, the petition is to be filed in the jurisdiction "in which the person whose name is to be changed resides." It should be heard where the child lives, not the parent.
