National Child Care Center misplaced my child

Weddnesday I arrived at daycare to pickup my daughter who was standing outside alone and no one knew she was missing. The next morning when I arrived I asked the Director who picked up my child yesterday. She was unable to tell me I picked her up even though she was sitting at her desk less than 2 feet away from the door my 6 year old was standing just outside of when I arrived talking on the phone. 14 calls later from her profusely apologizing, offering to resign and promising an internal investigation to see what went wrong. Assuming nothing is done to my satisfaction do I have any legal recourse?

I'm not really sure, considering nothing happened (thankfully) to your child. You may want to phone your localities department of child services and see what they recommend. If its happening to your child, you can be sure its happening to other peoples children. What a shame!

Legal recourse for what? One has to have sustained

damages(normally)allegedly caused by the neglectful action or omission of another in order to have a viable case in court for the type of scenario which you've described.

I see no such damages(legally recoverable)in your case for the incident you've described.(And, no, distress and/or pain and suffering would not be recoverable damages for this particular incident.)
