Legal Question in Family Law in Virginia

My nephew was removed from the home due to parental neglect. I was never told that I could have custody of him and now they are thinking of placing him for adoption with the foster parents. No one in the family was notified so we could have done something then and now they are saying we dont have any rights. Can you tell me if there is anything we can do at this point.

DSS is required to consider family placements. It is not required that the child be placed with a family. However, DSS needs to consider you and make a decision. You should contact the parent's attorney to discuss this.
