return custudy case fr. tn. to va.

may 27, 2006 my x- husband, 10 month old child, and i lived in knoxville tn. we decited to get a divorce. i moved to va.may 2006. i've lived in va. for 2yrs.4mo. he filed for custudy and divorce in knoxville.when i left in 2006. so last august 10,2007, we signed divorce papers and a parenting .i was told that the custudy case has to stay in knoxville tn because that is where it was fild.even though we lived in va. for over 2 years. this in inporting to me because the x has done nothing he is suppost to. like get the child 120 days a year, which he gets to take off my child support- because he got those days.-[1/2 medicals he don't pay]

[a drug test ever 3 mo. for a year. i have never got one.] he said he don't have to give me one unless he gets our son. so he has done a

big NOTHING. but i was told that tn. dont like people to take there x to court often and he would just order him to pay you and he won't ,so we would be back where we started and judge swan wount take is rights to be a father away.

what more can a parent do to his child -[dont call ] [seen him 2-t in 1 yr.] [never gave me a drug test] owes me as part of the divorce settlement 2,500.00 can i have the custudy brought back to va. will my x have to come to va

No, the custody matter does not have to stay in Tennessee since the children no longer reside there, and are now subject to the jurisdiction of Virginia, having lived in the Commonwealth for more than two years.
