Legal Question in Family Law in Virginia

Does he have rights?

My daughter's father has never seen her and has made it clear he wants nothing to do with her. If I go after child support does he have any rights or can I get sole custody? From what I understand he has become a violent person with his stepson and I would prefer for him not to have any access to my daughter and am curious as to my option versus his rights.

Re: Does he have rights?

You as the natural parent with physical

custody of the child are already presumed in the law to have "sole custody". If you're awarded child support, the father would have the right to petition for visitation rights with the child.
