Legal Question in Family Law in Virginia

Unethical Lawyer

I was being represented in a bankruptcy case by an attorney who I later found was also representing my wife in a child custody case. The lawyer told my wife all about my bankruptcy (which I did not want her to know about at this time) And details of the bankruptcy. I have already fired the attorney and got my money back, but I am afraid that my wife can use the things that the lawyer told her to get an upper hand on me in the child custody case. I am very seriously thinking about reporting the attorney to the state bar. I was wondering if I can sue the lawyer for breaking confidentiality and conflict of interest.

Re: Unethical Lawyer

Yes, this would appear to be an ethical lapse on the part of the attorney that should be reported to the Virginia State Bar. However, until you have incurred measurable damages from this attorney's apparent malpractice, a civil lawsuit against this person would not appear to be yet in order.
