Legal Question in Civil Litigation in Virginia

4 wheeler runs into truck

Hi my son has a 1985 Toyota ForRunner. He was on private property at a 4 wheeling event. His truck was parked when a 4 wheeler ran into it damaging the door & front fender. Who is liable for the damage the owner of the 4wheeler or the driver of the 4 wheeler? They are not in the same family. the owner is an adult the driver is a young person maybe 17. We have some of their personal info. Should we take them to small claim court. If so the owner or the driver? No insurance would come in to play would it. My son only has liability on his vehicle. I don't think 4 wheelers are insured. My son told them he would accept $300.00 & fix it himself. but the owner says the driver is liable. Let me know what u think Thanks. The police were not called because it happened on private property.

Re: 4 wheeler runs into truck

The owner is right; the one who caused the damage by his negligent driving is liable.
