Legal Question in Civil Litigation in Virginia

Breach of Contract

I sued the sellers of my home for fraud and misrepresentation. We reached an agreement that they would buy the house back. One of the sellers has declared bankruptcy; however, they were jointly and severally responsible to buy it back. The date has passed for the other seller to complete the agreed upon re-purchase. What can I do regarding the breach of contract?

Re: Breach of Contract

You can sue the non-bankrupt seller to compel him/her to complete the deal and for damages. If this was a fraud claim, you should also seek an exception to discharge of the bankrupt seller if you are still within the time to do so. IMMEDIATELY consult a lawyer, as the deadline is 60 days from the first date set for the meeting of creditors ( 341 meeting) in the bankruptcy case.
