Legal Question in Insurance Law in Virginia

Contract Vadality

I had a disability policy that paid me $1,200 dollars per month for the entire duration of my disability. I was hurt in 2001 and went on some major narcotics. While I was recovering the insurance company offered me $25,000 for if I would surrender the policy. Being in a haze I thought that was a good deal. After being on continuious disability I have found out I got screwed. I would have never done this had I been in a clear state of mind. Is there any way of going back to the insurance company after 5 years and sueing them for taking advantage of someone that was out of their mind at the time they signed the contract. I kick myself everyday for doing this to my family. I has taking ocycontin, and oxy IR.

Re: Contract Vadality

So, how was the insurance carrier suppose to know that the someone whom they were dealing with was "someone that was out of their mind at the time they signed the contract"?

No, I don't think so,(in my opinion) in answer to your main question.
