Legal Question in Medical Malpractice in Virginia

How long should I wait?

I hired an attorney in 2007, when my brother was in the hospital and the state of virginia was trying to take custody of him due to hospital bill, unfortunately, my brother passed away after being in the hospital for seven months. I went on to ask my attorney about a malpractice suit. He told me, he would need to get a medical expert to look at my brother's hospital records. It has been one year and my attorney still has not found a medical expert and I have paid him $1500.00 of my hard earned money. The statue of limitation will be up next year in may. Is this too long to wait? Should I move my case to another attorney?

Yes, it's probably too long now for you to have to wait. You may now wish to give this attorney written notice that he has no more than 60 days to secure this expert review of your brother's medical records or he will be discharged as your attorney in the matter and new counsel will be found to replace him.
