Legal Question in Personal Injury in Virginia

I was in an auto accident back in June. I went to the emergency room and have had follow up with my doctor and will start seeing a chiropractor today. The other party was found at fault for following too closely. His insurance is telling me that if my health insurance pays any of my medical claims that they will not pay the claims. I don't think it is right that my health insurance should be responsible for something that wasn't my fault. Are they telling me correct information?

Submit your medical claims (if possible) directly to the other driver's insurer.
