Legal Question in Personal Injury in Virginia

hit from behind

I had surgery in January, a herniated disk. I was hit from behind in DC while driving in a company vehicle in June, the incident was not reported to police, they usually do not respond to minor accidents. I did get the other drivers name and phone number. The next day I started to have problems and went to see my doctor, followed by a MRI and learned my disk was re-herniated. I am not sure how to handle the situation, the driver was contacted, however he did not respond. I know my insurance company will want to get money from him, as well as myself since I am out on disability. What do I do? Thank you. Bonny

You do have a claim against the other driver (and, through him/her, the insurance co.). You should see a lawyer who handles DC personal injury matters as soon as possible. The fact that the incident was not reported to the police could be a problem, but should not be fatal to your claim.
