payment for medical expenses incurred as a result of food poisoning

I contracted a severe case of food poisoning as a result of the dinner I consumed at a restaraunt (Jan 4). After notifying the owner, she was apologetic and offered to pay for my medical expenses. I have sent her detailed bills on three separate occasions. She has assured me verbally a minimum of 10 times that a check would be forthcoming and had her accountant write a letter which states that they would pay for medical expenses. For the past two months she has not responded to my letters or inquiries. I sent her a letter requesting payment within ten business days of receipt. She did not respond. Do I have a case against this woman?

It appears so especially in light of her accountant's letter, who was acting as the agent of the owner of the resturant. Go file a warrant in debt in general district court and once it is served on the owner (make sure you have the correct name of the owner, and if it's a corporation, the correct name of an officer of the corporation)on whom the papers are to be served, Isuspect the money will be forthcoming.
