Legal Question in Personal Injury in Virginia

I was walking my dog, while I was walking pass by another person walking his dog, his dog attacked my dog, and I got bit while I tried to save my dog. The other person got charged by the city, and I received subpoena to be a witness for his charges. The orginial court date was few months ago, and he put a continue for until next month. The problem is that I am going oversea, I cannot able to report on my court date. I had ask the court clerk, they cannot continue the case for a year. What happen if I cannot show up in court testify? Will the case get dismiss? What can I do to be able to make the defendent deserve what he get?

If you're not there, the case will likely be dismissed. You could check with the

local prosecutor or whoever is charged with prosecuting the matter for the city to see if some form of subsitute testimony from you might be used in your absence.

Also, if you were injured in this attack, you yourself could sue the defendant

in small claims court for your damages upon your return.
