Legal Question in Real Estate Law in Virginia

not allowed to pay a cure for a lein

I was late on a property payment and the lein holder (owner) would not allow me to pay the amount owned before the trustee sale, is this legal? I tried and tried, they refused.

Re: not allowed to pay a cure for a lein

The provisions contained in your deed of trust document regarding this issue should control. If the lien holder was not required to afford you additional time to pay under the provisions of the deed of trust document, then his refusal was quite "legal".

Nevertheless, there would have been nothing to prevent you from bidding on the property at the trustee's sale (assuming that you had the wherewithal to do so).
