Legal Question in Real Estate Law in Virginia

fencin

Is there any law governing barbed wire between lawns or electric fencing between lawns. I have a 15 month old, and I have two elderly parents with heart conditions. My neighbor put up an electric fence and topped it with a straint of barbed wire. They do have chickens but no other live stock. Can this legally be done on a property line? If not how can I get it removed?

Re: fencing

The fence may also be goverened by covenants or other private agreements. This would have to researched at the courthouse, and you would already likely be aware if this is the case.

Re: fencin

You might wish to call the local office responsible for zoning matters in your area and get their opinion on this issue. If they don't have an opinion they might be able to refer you to another agency which does.

My own sense of things is that the electric fence which your neighbor has erected is probably legal. However, if anyone is injured from this fence as a result of the neigbor's failure to put in place appropriate protective measures, the neigbor could well be civilly liable for negligence and for the damages resulting therefrom.
