Security Deposit

About a month ago, I put a security deposit down on a condo in a different state in which I thought I would be starting a new job. The job fell through. I had not yet signed the lease nor had I even received the key to the place. After notifying the real estate agent of my job loss, he said that I probably won't get my security deposit back. Is it legal for him to keep my deposit when I hadn't yet moved in and didn't sign the lease? He's also been successful in finding another renter for the condo within two weeks after I told him I couldn't move in.

Well, what was the reason offered by the agent to suggest that your deposit would not be returnable under these circumstances?

Until that is known, in my opinion this question cannot really be answered.
