Legal Question in Real Estate Law in Virginia

I want a separation from my husband, he refuses to sign an separation agreement and refuses to leave my apt (his name is not on the lease). He does receive mail there only because he was on deployment and had nowhere else to send his mail. He just bought a new car and registered it to my apt even though he knows I want him out. What can I do. I'm trying to give him everything I own to get him to leave but he still refuses to search for an apt or go stay with a friend. Please help!! State of Virginia.

You could file for a temporary order in your local circuit court asking

that the court award you sole possession of the marital residence (assuming

that's what it is) and whatever else that might be approrpriate, pending

entry of your final decree of divorce.
