Legal Question in Wills and Trusts in Virginia

Brother keeping secrets

My brother will be applying for Administrator of our Dads estate, my sister and I sent him ''Wavier of Qualification'' from us to take to the court. ''My sister and I live in other states''. He has told my sister and I that the person he needs to see in the Gloucester court hasn't been at work all week, so he hasn't` been able to get an appointment.

My brother was supposed to call me when he got my dads bank statements to let me know what we are dealing with. ''My dad also has land, 7+ acres, and a Mobile home'' paid for, and in my fathers name only. Seems my brother wants to keep all the financial info to himself.

Will my sister and I ever be notified by anyone from the courts when my brother applies for Administrator?

Re: Brother keeping secrets

The executor (personal representative) is obligated to take a complete inventory of all of the decedent's property, of all types, down to the last penny. This must be filed with the court and if you are an heir you must be provided with a copy. Furthermore, the executor must report where every penny went, including with documentation with receipts.

However, most people don't know what the requirements are. Therefore, there is no guarantee that what should be done actually will be done.
