regarding wills, if the executor of the will is not resident of virginia and holds no actual residency in any state and they have been named as an executor in will is this legal

Yes, it's leagal. Virginia law permits certain relatives, such as children, parents and siblings, who are not Virginia residents to serve as executors by merely naming someone in Virginia to accept service on their behalf.
