Legal Question in Disability Law in Washington

Do not contact violation

My husband placed a do not contact order on my 19 yo son for 1 yr. but within that year son violated order and pled guilty to gross misdemeanor fo rit, so judge added two years to it. Son was caught staying at dad's house and has served time for violating DOC and is set to see judge this week for violation of probation. He has old charges (VUSCA and Assault 4, and above gross misdeamenor) but nothing for past year. Does this charge generally receive a 1 yr sentence? He has a Public defender he has not met yet and court is Wednesday. His dad has tried to get the order dropped so he can see son but guess he doesn't have the power to do so. What are usual sentencing guidelines for probation violation adn 2nd time to ignore the do not contact? Should I be cashing out my retirement to get him a lawyer on this?

Re: Do not contact violation

It is difficult to say. What court is this in? You need someone familiar with the particular Judge to know a likely sentence. The public defender probably is familiar but good luck reaching him in time to get an opinion. Generally speaking, the charge does not receive a one year sentence but there are judges that will do so. Feel free to contact me directly to follow up.
