Filing Bankruptcy and an Eviction

Is it true that filing Chapter 7 bankruptcy will put a hold on an eviction? How long of a hold, and how long does it take to file bankruptcy? I'm to be in court on 02/01/06 for an eviction, and a friend advised me file bankruptcy.I also have other outstanding debts as well as this eviction. I have a 6 month old baby and I need to provide a home for us.

Filing bankruptcy does put an eviction on hold, or any other legal action for that matter. However, under the current bankruptcy rules, you must first attend a credit counseling class prior to filing. Thus, I don't think that it is likely that you will be able to file prior to your eviction proceeding. If you would like to file for bankruptcy please contact me.
